Civil conflicts

Civil litigation involves two or more parties and can be rooted in real property, commercial, construction-related, contract, tort, insurance, professional, or probate/trust disputes. However narrow or broad the controversy and however many parties may be involved, our purpose is to accommodate a meaningful confrontation of the issues and facilitate a negotiation toward resolution of some or all features of the conflict.

It is not the neutral’s role to make a decision for, or provide any particular directive or advice to, any party. Nonetheless, though the parties ultimately decide whether a settlement will be reached, the mediator will assist in examining legal and factual issues and developing satisfactory solutions to pending conflict.

Our process anticipates robust briefing of facts and law by each party. Following review of party briefs, the mediator will offer introductory Zoom conferences with respective parties, after which pre-session meetings (telephonic or via video conference) with counsel for the separate parties will be held. The calendared session will begin, according to the preference of counsel, as a joint conference, an individual-party caucus, or a multi-party caucus.
